Welcome to PropertyMatch. These Terms of Service ("Terms") govern your use of the PropertyMatch platform operated by PropertyMatch ("we," "our," or "us"). By accessing or using PropertyMatch, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our platform.

PropertyMatch is a digital platform that connects home sellers with qualified real estate agents through a competitive bidding system. Our services include:

• Property listing services for home sellers (free of charge)
• Agent bidding system with point-based transactions
• Direct communication tools between agents and sellers
• Profile management for real estate professionals
• Payment processing for point purchases and subscriptions

User Accounts and Eligibility

Eligibility Requirements

• You must be at least 18 years old to use PropertyMatch
• Real estate agents must hold a valid real estate license
• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account

Account Responsibilities

• Maintain accurate and up-to-date profile information
• Protect your account credentials and notify us of any unauthorized access
• Comply with all applicable laws and regulations
• Use the platform only for legitimate real estate transactions

Platform Rules and Conduct

Prohibited Activities

Users may not:

• Post false, misleading, or fraudulent information
• Harass, threaten, or abuse other users
• Attempt to circumvent the bidding system or payment processes
• Use automated tools or bots to access the platform
• Violate any applicable laws or regulations
• Impersonate other individuals or entities
• Share inappropriate or offensive content
• Attempt to hack, disrupt, or damage the platform

Content Standards

• Property listings must be accurate and represent real properties
• Agent profiles must contain truthful professional information
• Photos and videos must be appropriate and relevant
• Communication must be professional and respectful

Bidding System and Point Structure

How the Bidding System Works

• Agents purchase points to bid on property listings
• Only the first 3 agents may bid on each property
• Sellers choose their preferred agent from received bids
• Points are consumed when bids are placed, regardless of outcome
• New agents receive 250 free bonus points upon registration

Point System Rules

• Points are non-refundable once used for bidding
• Points cannot be transferred between users
• Unused points do not expire but cannot be exchanged for cash
• Point pricing and packages are subject to change with notice

Payment Terms

Payment Processing

• All payments are processed securely through Stripe
• Payment information is encrypted and never stored on our servers
• You authorize us to charge your selected payment method
• Failed payments may result in account restrictions

Pricing and Billing

• Current pricing is displayed during the purchase process
• Prices are subject to change with 30 days notice
• Subscription renewals are automatic unless cancelled
• Taxes may apply based on your location

Refund Policy

• Points used for bidding are non-refundable
• Unused points may be refunded within 30 days of purchase
• Subscription fees may be prorated for early cancellation

Intellectual Property

Platform Content

PropertyMatch and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

User-Generated Content

• You retain ownership of content you upload (photos, videos, descriptions)
• You grant us a license to use, display, and distribute your content on the platform
• You represent that you have the right to share all uploaded content
• We may remove content that violates these Terms or applicable laws

Disclaimers and Limitations

Service Availability

• We may suspend or terminate service for maintenance or updates
• We are not responsible for third-party service interruptions

Transaction Outcomes

• We facilitate connections but do not guarantee successful transactions
• Users are responsible for verifying credentials and qualifications
• We are not party to agreements between agents and sellers
• Users assume all risks associated with real estate transactions

Limitation of Liability

To the maximum extent permitted by law, PropertyMatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Account Termination

Termination by User

• You may delete your account at any time through account settings
• Unused points may be refunded within 30 days of account deletion
• Active subscriptions will be cancelled upon account termination

Termination by PropertyMatch

• We may suspend or terminate accounts that violate these Terms
• We may terminate accounts with 30 days notice for any reason
• Immediate termination may occur for serious violations or illegal activity
• Terminated users may not create new accounts without permission

Dispute Resolution

Platform Disputes

Legal Disputes

Any disputes that cannot be resolved through direct communication shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
